Final decree application

(Querist) 23 March 2024 This query is : Resolved
I am the respondent in a property partition final decree case.I have no objection to the arguments of the plaintiffs. At the present time I do not have the money or time to attend this case in person or arrange a lawyer. Will there be any reduction in the my share while partition by court in my absence?
T. Kalaiselvan, Advocate (Expert) 23 March 2024
In a partition suit the defendants are also at par with the plaintiffs and their entitlement for a share would have been decided in the preliminary decree itself, therefore there is no question of reducing yor share in the final decree even if you are set exparte for non appearance.
You may just lose the opportunity to object to the allocation of a particular share to you if you do not attend the court case hearing in the final stage when the court passes its decision.
