My father is disagree with this so my grandparents and aunts made more than 13 fake case against us including attempt to murder on hearing day when we went to District judge then he said that I know this is matter of property so they made this type of cases. so he told my father that you have to give share in your property to my grand parents and aunts but my father denied and told that you know this is fake case and they are playing with future of our children and I have to marry my daughters and also they sold our ancestor's property without my consent but judge does not agree. we requested him that this time we are studying so make good justice they want out property so they played this game then judge told my father if you do not want to give share then fight in case and told us that money can not do any thing in marriage and study. we requested him but he always make pressure on father that do as I said. we do not know what should we do. My parents are scare to take our future. In above what we can say when District judge know all thing but they do not act against them because they filed more than 13 fake cases against us and does any law says that grandparents and aunts has right on my father's property. even grandparents have also a bog property where we lived all they start self to made that but after my father also helped in that. please suggest me what should we do, we are scary and their lawyers are playing on only money so they helped them and judge took theirs side, S.P. and S.D.O. also said that all fault are of my grandparents and they told that all are fake cases and do not try to interrupt in their study but grand parents, aunts and their lawyers does not listen this. requesting to help me. i am a resident of india for the past 20 years. My son and daughter got migrated to Canada. I was residing in a rented flat alone ever since my children went to Canada. I booked a flat with a builder in 1998 for 58 lakhs. The builder had promised to handover the possession of the flat in 2000 as per the brochure and an agreement for sale was accordingly entered between myself and the builder. I had mobilised the funds by way of Bank Loan and financial assistance from my son apart from my own funds. However the construction got delayed as the builder could not obtain necessary permission from various authorities. I went to Canada in 2000 to visit my son and continued to live with him though I used to visit India twice a year. I did not acquire a Canadian citizenship. In 2002 I filed a complaint before the Consumer Disputes Redressal Commission claiming compensation of Rs.1.50 crore which included the cost of the flat considering the price escalation, loss on account of possible rental income if the flat was completed in time and compensation of mental agony and hardship. The Consumer commission dismissed the case holding that I was not a consumer and the transaction was commercial in nature. The judgement was upheld in the National Consumer dispute redressal commission also. Aggrieved by the judgement, I have approached the Hon'ble Supreme Court. My concerns are as under: 1. Whether my application is maintainable in Hon'ble Supreme court? 2. Whether I am a consumer? 3. Whether the transaction was commercial? I would request you to refer me the relevant sections and the case laws on my each questions to let me upheld my case with strong hands. I would also request you to let me know how would the opposite party (defendent) would defend his case on the above questions and the supporting sections and case laws relevant to them so that I can prepare for them too. Requesting you to help me. Yours faithfully.

  • sayanghoshmondal says : divorce under adultery
Respected sir, My parents are married for about 30 yrs. Out of the wedlock of them 2 children were born, me and my sister. I am about 26 yrs old and my sister is about 21 yrs old, and our education is going on, and both of us are unmarried. My father was director of a central govt. medical college and recently retired from service and gets a pension of about 60000rs. My mother is class 12 pass. We have a house which is joint property of my father and mother. My mother is a housewife and until now is residing in the said house. My father built the house from his own income and taking loan from the bank(the loan has been paid in full). For last 10 yrs my mother has led her life in adultery with various persons of which me and my sister are eyewitness. My parents have no physical relation for past 10 yrs. But we all live in the said house. Me and my sister want to stay with my father if finally separation takes place. Recently my father has filed a divorce case under adultery, cruelty and desertion. After that my mother has filed a case for inter rim maintenance under section 24 of HMA, and requesting the court to pay her 26000rs per month and 60000rs one time for litigation expenses. My questions are- 1. What may be the approx amount my father has to pay her as inter rim maintenance? 2. What is the approx amount of time to solve the whole matter? 3. After the case is solved is there any chance that my father has to pay maintenance to her? 4. Is there any provision in law where major children can file a case against their adulterious mother on ground of cruelty? pls help
