trade marks act

theres a swiss company which has licensed the trademark and permitted the use to an indian company.
so does it needs to register in india also, what protection does it enjoy,,,, what section of trade marks act 1999?

yes u have to register the same here in india on the basis of license granted to u.

A swiss company has to apply first in India and there after a swiss company will give permission to use a mark to Indian Company ans the same will be recorded in Trademark Registry as registered user.

generally, foreign companies are allowed Indian company to use the mark but not allow to claim ownership/proprietorship over a mark or give right to apply for registration.
