Compensation to third party

Dear Sirs, I am in need of a good ruling. Facts are: Deceased is third party, the tractor-trailer insured for agricultural purpose is alleged to be used for commercial purpose at the time of accident and hit the deceased pedestrain who died.

Please give a ruling in such cases stating that insurance company is liable to pay compensation to third party even if the tractor trailer meant for agricultural purpose is used for commercial purpose.

I think the insurance company is not liable to make compensation.

If the petition is filed under Section 163(A), MV Act the ruling may not be needed.
