Prolem in registered housing socity

(Querist) 09 October 2012 This query is : Resolved

ours is registered socity, out of 10 residential flat only 8 members are actually living there.

Chairman lady is not leaving the post since last 10 yrs.
she is in always either secretary or chairman. how to make her leave this post?
4 members always support her as they do not want to work.
she acts like hiteler and gives mental torture to us.
Like me there are only 3 people who want her to go but rest 6 ppl support her so it has not been possible
Does not allow us to use the terrace.
what is law about terrace which is common property?

Please share with us your society bye-laws.

The society cannot disallow the access granted to you through the purchase. Society can only initiate legal action through proper channel and cannot restrict members from using and accessing basic amenities including common area for lawful purposes without affecting others.

If any action that violate Co-op Soc Act, Rules & bye-laws, u can apply Registrar to appoint Administrator to manage affairs of Society.

U must prove, they are acting Ultravires, "Manmani kar rahe hai"
Their act is against the interest of remaining members.
