Reg Rented Property dispute

Sir,
My uncle is doing his business last from 5 yrs in a rented property and rent is Rs. 15500/- p.m. Now the Landlord wants to vacant that property but my uncle has no other property to continue his business and is very difficult to find another rented property.

Also he has the proof of rented in it as he is paying the electricity bill by cheque.

Pls guide on what ground can my uncle remain in the rented property or can the landlord has the right to vacant that property.

Other points:
1. Rented property is in Delhi
2. Rent paid is in cash
3. Landlord is giving any receipt for the rent paid
4. Also landlord has not paid 2% tax for rent received

Pls suggest.

The landlord will have to give notice before filing the case for eviction.

You can also file a case for standard rent and take order from the court to pay rent in the court.

You should have very experienced advocate to handle the matter, mistakes done at initial stages becomes fatal later.

the tenant cannot be evicted at the whim and fancy of the land lord. the land lord must make out lawful grounds contemplated under the rent control laws to evict the tenant.you can wait till the land lord moves his coin. then you can plan your defence and act accordingly. if the land lord tries to use force to evict,you are not without remedy. you can move the civil court for injunction order since you are entitled to legal protection till you are evicted by due process of law.
