Claim on my mother's father's property

Querist : Anonymous (Querist) 13 March 2011 This query is : Resolved
My mother died about 8 months ago. Can I claim on her father's property? I have a power of attorney from her signed in September 2009. She did file a police complain over her 3 brothers and one sister in 2009 end and sent a notice through her lawyer but never moved to court. Her father died in 1994 and her mother died in 1998.
In 1994, her brothers claim, she has signed a legal document and surrendered all her property rights. Can you please suggest, can I claim on her property rights now and how do I make my case strong. What points go against me

Your mother executed POA during her life time and after her death it is not valid.
What are the properties?
If all are ancestral you can claim share.
If any self acquired, you cannot claim

As rightly pointed out,the GPA expires with the Principal. You have to ascertain the document executed by your mother in favour of her brothers. Then only we can know where you stand.

The property which belongs to your mother's father and mother, whether ancestral or self aquired,if they died intestate(not leaving behind any will)you have equal share with your maternal uncle and ant's(if prperty is not an agricultural land). After the death of your mother, the said power of attorney has no legal force.

As per your facts you can not take action against the property of your mother' father.
