name change of a person residing offshore

I am residing abroad, when i applied for passport and visa, i noticed that in my school leaving certificate and in my Certifciate of Diploma my name was printed as sHanmugam instead of sanmugam.Niw i want to change my name as sHanmugam. When i enquired my lawyer he advised me to go usual name change policy by publishing in Govt., Gazette. As i am in abraod, he also advised me to send back notarised version of one affidavit and the proforma application to be submitted to the govt authorities. Kindly note my passport and visa are all in the name of sHanmugam. Though it is mere inclusion of an alphabet, to avoid future consequences i wish to change my name as sHanmugam.
My query is two prong:
a) whether an indian residing in offshore can change has name by following usual policy available in india.
b)whether notarised affidavit would work?

Your residence abroad cannot and does not alter your nationality. You are still bound by indian laws as you are an indian as of now. Therefore you can follow the said procedure for changing the spelling. Nothing wrong in it.
