I have applied for trademark registration for my business name, but the application is still under examination. Can I start using the brand name and logo for my products and marketing before the trademark is officially registered? Are there any legal risks if someone else claims ownership during this period?

You can legally start using your brand name and logo while your trademark application is pending. However, doing so carries distinct risks because a pending application grants you no active legal protection until it is fully registered.
However, if a company already owns a registered trademark that is identical or confusingly similar to yours in a related industry, using your brand right now puts you at risk of trademark infringement.
They can send you a Cease and Desist letter, force you to stop using the name immediately, destroy existing marketing materials or inventory, and potentially sue you for damages.
The trademark office examiner will likely find their older mark during your examination phase and refuse your application.
If you absolutely cannot wait for the registration to clear, you should ideally have a professional comprehensive trademark clearance search performed. Checking standard search engines or basic business registries isn't enough; you need to ensure there are no confusingly similar phonetic or visual marks already active in your specific trade class.
