commercial use of tractor/claim petition

I am representing a tractor owner in a claim petition(Death Case)Tractor is insured for agriculture use only but at the time of accident tractor was being used for transporation of bricks(Commercial use)Insurance co. has taken a plea that as the tractor was indulged in commercial activities,wheras tractor was insured for agriculture work only.so tractor owner/insured violate policy term and conditions,therefore insurance co. is not liable.What i can do in given facts.Kindly help.Thanx

There is violation of policy terms. Hence insurance company is not liable.

Try to show that the transportation of bricks was in aid of your agriculture use.
