To get back my sold property

(Querist) 08 July 2011 This query is : Resolved
Hi Experts,

Iam looking for a proper solution, which make my mind restless.

We have a grand parents property within chennai limit, we have full right of what ever we want to do, me and my brother alone have the rights on the property and we sold half portion of property say 80 cent at a period of 2005 at a cost of less than 50 lakhs and more over we both have no idea of economic booming on the real estate side. Now the property value has gone high at a cost of say 4 crores.

This make more stress to me and my brother body and soul.

Now i need a good knowledge from an expert that any way to get back my solded property or get additional cost on the land which we sold a cheaper cost.

Looking for positive feedback .

Thanks,
Babu

Thanks all for your reply,

The said property was belong to my grand mother( ie., father's mother) who created a will and got decree by highcout chennai during 1970 clearly stating all the property belong to their grand son's. So as per will me and brother alone have the right.

Now my question is :

My one and only elder sister if she applied against the will in the court which was created in 1970 and decree passed by chennai highcourt by using current law stating equal right on property for women, whether she can get break that will as well as the decree passed, if so in that case, she may got a right to put a suit against my sold property right.

Please through a light on this.

Once the transaction is completed by you, there can be no going back and you will end up in more mental agony fighting legal cases which will be of no use, so sincere advise to you is be content with what you have and be careful in money matters in future.

Find out as to whether anybody else had any right over the said property. If yes, you can do something with the help of those persons who had a right over the said property, for setting aside the sale.

Querist has clearly stated that himself and his brother alone have right over the property. Even otherwise the sale deed generally contains an indemnity clause against any defects in the title and declaration to the effect that the vendors have clear and marketable title to the land. Hence it would be suicidal to institute any suit with cooked up facts.
