can a french citizen execute a hiba nama in india as she was married to a muslim but remained a french citizen till her death and also was a born christian and remained a christian till her death

Hibanama does not seem to be proper by a non-muslim lady in a non-muslim country.

but the crux of the issue is that the person who got wrote the hiba is trying tooth n nail to prove she is a muslim by producing her hospital records where she was admitted with a hip fracture and the records mention her religion as muslim because her son admitted her and he wrote his religion and the death certificate mentions only the nationality as french but in their register they have entered as muslim.As her husband was a muslim the children became muslims but she remained a christian till her death.Can the courts take these entries as proof and is it sufficient to convince the courts she was a muslim.Her passport reads as christian and as a french national.Please guide me on this matter.
