Forged document

In a chitty agreement, the signature of the guarantor is forged. what will be the fate of the document if it is proved that the signature has been forged. Can an order be passed against the person other than the guarantor in a forged document?

Dear Sangeeth,

The Agreement is voidable in so far the clause governing Guarantee is concerned rest of the clauses shall still be valid in the eyes of law. As per the Criminal law the person responsible for committing forgery is responsible whether he is guarantor himself or any body else for that reason.
