Caveat is to be lodged in the Court to which appeal from the Judgment to be impugned lies. Different States in India have different rules with regard to Original Jurisdiction for trial of a suit and for appeal. You will have to tell the name of the State where the suit has been proceeding and the appeal is to be filed?

If the order is passed by the Civil Judge (Senior Division) at Taluk level, caveat lies in the District Court. And if the order is passed by the Civil Judge (Senior Division) at District level, it lies in the High Court.
