I want to know the exact number of days for which maternity leave can be permissible as per the Act.

If an employee want to get more than 90 days leave than she can or not...

Each Company would be having its own policy in such matters. If you have to take more than the permitted days of Maternity leave, then you may have to apply for leave without pay, provided such leave is allowed by your Company. Since you are working in the I.T. Company, please ascertain the details from your HR Department.

I m from HR dept only. As per our leave policy,90 days maternity leave is permissible. And we are thinking of additional30 days as special maternity leave to employee.......

Can u please suggest me for the same ?

Hello Sir,

I wnat to also confirmed that Act suggested that 12 weeks is permissable days of Maternity Leave, so evry one take it as 90 days.

Yes, your company if it wants to grant additional 30 days (in addition to original 90 days towards maternity leave) special maternity leave, you can go ahead and do it.

KINDLY NOTE THAT MATERNITY LEAVE IS 90 DAYS.IT IS PAID LEAVE.IT IS AS PER ACT.ANY FURTHER LEAVE CAN BE TREATED AS SPECIAL SICK LEAVE WITH REFERENCE TO SERVICE REGULATIONS OF ANY CO. THE CO.CAN DECIDE WHETHER IT IS PAID LEAVE OR LEAVE WITHOUT PAY WITHOUT AFFECTING THE CONTINUITY IN SERVICE OF THE EMPLOYEE.GOOD LUCK.

Section 10 of the Maternity Benefits Acts, 1961, provides additional leave of one month on the rates of maternity benefits in certain conditions, as can be seen in the extract of s.10 below:

Sec.10: Leave for illness arising out of pregnancy, delivery, premature birth of child, or miscarriage. -- A woman suffering illness arising out of pregnancy, delivery, premature birth of child or miscarriage shall, on production of such proof as may be prescribed, be entitled in addition to the period of absence allowed to her under section 6, or, as the case may be, under section 9, to leave with wages at the rate of maternity benefit for a maximum period of one month.
