Robbery of insured vehicle

(Querist) 28 January 2011 This query is : Resolved 
Respected experts,
a vehicle has robbery by accused,when vehicle was on the way.
vehicle was driving by owner's servent(driver) who has no driving licence.
however owner has velid driving licence.
the accused arresed,went to jail.
vehicle was not recover due to sold to unknown person by the accused.
owner file claim of the vehicle.
insurence company refuse the claim due to no driving licence from the driver.


It is not a case of accident , it is a case of robbery can owner get claim?

Sir I think there is no remedy as owner has already violated the terms of insurance policy. Let the answer come from the learned members.
