Hi Team
My Grandpa has 10 acres of agriculture land and he got this land from his father in law and now my grandpa has expired without distrubiting this land and there is no will. Now my father's sisters & brothers are asking for this land are they legally own the rights both sister & brother of my father. Kindly advice
This land is in Andhra Pradesh, chittor District

The property is in your grandfather's name. He has not distributed the property nor has left any WILL. Therefore the property will go in equal share to all his children i.e. your father, his brother(s) and sister(s). In other words, all the children of your grandfather including his wife (if alive) are legally entitled to equal share.

Thank You Mr Ramachandran, but I heard that in AP if womens who have married after 1987 are liable for equal share & not before that is it true.
If already we have given some lands to her at the time of mariage then also we need to give again equal share.

Dear Anonymous,
That is true in regard to ancestral property. But not for self-acquired property of your grand father. Even if you had given some land, then also you have to give equal share in the remaining land.

But my Grandpa has not purchased this land it is given gift by his father in law for staying in his house with his daughter because they didnot have sons, now we are staying there house only.
So doesn't this matter , please tell me .

It is precisely because that the property did not come to him from his male ancestors, but from his father-in-law, it is not an ancestral property. It is only his private property. Therefore my answer above.

In absence of will, all the Legal heirs will have equal share in the ancestral property. Though it is not ancestral to your grand father, the property gifted is deemed to be a self acquired one and have same value
