Dear Sirs,
Mr.A (First Buyer) has purchase a Flat in a newly constructed Building in Mumbai from the Builder during 1991. Mr. A has not paid any stamp duty and not registered the said agreement document. Then, I have purchase the said Flat from Mr. A during 1996 and I have paid the proper stamp duty on my purchase and got the document registered. The said Flat has transfer in my name during 1996 itself.
I want to know whether the society now ask me to pay stamp duty on the first sale between Builder & Mr. A ?
Is there any consequences of above. Conveyance of our society is pending.
Please reply.
Thanks.

never purchase a flat wherein your prredecessor has not paid stamp duty and registation charges . has the society made any claim from you ? if so you can seek to recover the same from seller .

Society will demand a Registered Agreement of Builder with Mr. A.
It is necessary for conveyance.
You are advised to Register it, and recover its cost from "A"

How could A transfer the flat when his own transfer deed was not registered.
Try to get NOC from the Builder regarding the transfer made in your favour.
