Renewal of passport while case is proceeding

Sir,
I I have a criminal case pending us138 against me. I want to renew my passport but there in annexure "I" affidavit point no 5 & 6 are not fulfilled.
there are 2 points which state that I should not have any criminal case pending against me and that I should not have had summons.
what should i do in that case??

File a petition u/s 482 Cr.P.C. for seeking direction to renew passport in question.
