The marriage was solemnized in Feb 2009 under Hindu marriage act. The girl have file 498A case against her husband and mother-in-law in September 2009. The case is going on and divorce case is not yet filed.The girl(wife) have strong proof to prove the case of 498A.The girl wants to get divorce as early as possible and also want alimony. The Separation period is 1year and 4months.What is the ready for her.

As per hindu marriage, you can't file divorce petition without complete one year.. But that girl can dispense her one year period.

There is no such exemption for women. Since 1 year has passed you can file suit for divorce on the ground of cruelty if you so wish.
