Compromise compounding

Querist : Anonymous (Querist) 20 March 2024 This query is : Resolved
hello experts,
i have been accused in a criminal state case, in which one section of IPC is not compoundable 452 IPC now i have compromised with the complainant so he is ready to take back the case, state of the case is arguments on charge, now my question is whether the case can be withdrawn at this stage it self if yes then how?
T. Kalaiselvan, Advocate (Expert) 21 March 2024
Even if that particular section alone is not compoundable. the case cannot be withdrawn by the defacto complainant.
Since the matter has arrived at final arguments stage, you cannot do anything about because the court has no powers permitting the defacto compliant to withdraw the non compoundable offence
