I got divorced under section 13(b) of hindu marriage act 1955 in 2008. I want to take my child out of India.How can I get custody documents or a court order in which it is clearly indicated that biological father has no access/custody rights of the child and the custody of the child is with the mother and a written permission from court to take the child out of country.The child is living with me and I am maintaining him alone since 2004..

If the child is with you and the passport is also with you then no separate permission of court is required.

No separate order is required, however your ex-husband may claim visiting rights and custody of child also. Generally up to the age of 05 year custody remains with mother. custody of child depends upon many factors,
