HI all
As per the delhi govt site, Obtaining license under Shop and establishment is not necessary from 1989 and the site was updated in 2004
can anyone guide me whether obtaining liceses under the same has become mandatory now??

can anyone suggest me a site or a source through which one can updates himself on all the developments that takes place in hte field of law as this is very important as the bare act does not contain the rules, regulation and there is a one liner there that all the rules, regulation would be published through notification, circular, in official gazette
now have also try to find out some of the gazeetee notification in both the site ie Indian govt site and delhi govt site and also sites meant for gazeete only like egazeetee, gazette of india but to no use

Sir,
I wrote 02 exams through Staff Sel.Com. (1) Stenographers (scale 4000-100-6000) (2) Clerk Grade(LDC) (scale 3050-75-4590).
Initially I got appointment order of Stenos and joined in Min. of Defence, New Delhi(Central Govt.). At the time of joining, I intimated about the application for (LDC)Clerks grade.
After doing as steno for 4 months, I got LDC appointment order and tendered technical Resignation and competent authority accepted the same and directed me to report in Survey of India, Hyderabad(Central Govt.) and reported there accordingly without break in service.
Then immediately, I applied for pay protection. The Head of Dept. fixed my pay under FR 27 at the minimum of Rs.3050/- instead of Rs.4,000/- (3950+50PP) which was drawn in previous post to ensure the minimum loss to the candidate.
Am I eligible to claim for pay protection. Is there any websites and material to appeal for the same. Kindly provide to my Email: rao_hyderabad2010.yahoo.com, for which act of kindness I shall be very much grateful to you.

HI
i have heard that Workmen compensation is not applicable where ESIC is applicbale
On perusal of the act, it was written that this act will not be applicable to teh factories act wherein ESIC is applicable
so it clearly means that it is applicable for establishment which are not factories wherein ESIC is there, correct me if i am wrong
and plz point out any clause, judgement, example you ahve to prove me wrong, i will be very greatful to you

Hai friends
my friend is working in Public sector company BHEL, working as Jr.Engineer. for 3 years. recently he got job in AP state govt job APGENCO. he joined in APGENCO without resigning from BHEL, by abscanding duty in BHEL. He has done job in APGENCO for 1 month only and then he return back to BHEL.
and the questions are.
1. If he drawn the salary from both the firm for one month what is the major punishment.
2. If he drawn the salary from APGENCO for one month and same one month period if he shows in BHEL as a absent period what is the major punishment.
planning to start a project which will be based on domestic housekeeping sector. For this purpose, we need some advice related to companies act & regulations and service tax.

* If all the law are same across India or differ on state to state bcz we have option of registering it at Delhi/ Gurgaon (Haryana)/ UP.
* Please also check if the registered office and operating offices are located in different state than what difference it makes compare to when both are in the same state.
Service Tax :-
* Is service tax applicable for the this kind of business.
* I believe that it is centralized and doesn't differ state to state. please check
* Applicable Service Tax (if any)
* Process of service tax registration ( if applicable)
Apart from above mentioned points, if you can or suggest someone who can can guide on labor laws as well related to this (like Registration, Labor Law, Minimum wages policy etc.)

plz let me know the benefits and implication of forming a trust. How it is formed and where it is registered. what and upto what extent Company forming the trust is reponsible in the wake of the fact that trust is a seperate entity altogether and who is answerable for trust works

Dismissal of Sub-Registrar
A sub-Registrar in Tamil Nadu went ahead and registered the Sale Deed of our property in favour of a land grabbing mafia by taking bribe despite the fact that a civil suit is pending in the lower court filed by me in which he (the sub-registrar) was included as defendant and served notice and declared ex-parte by the court. Shocked by the illegal registration, I filed a WRIT in the High Court of Madras seeking cancellation of the Sale Deed Registration, narrating the full story. Unfortunately, the WRIT petition was dismissed quoting that the registration was done as per the Registration Act under Section 34 and Rule 55 which states that the registering officials need not verify the ownership of the property and as long as the buyer and seller mutually agree, their identity verified and both the parties are in sound mind, the registering official cannot deny or refuse registration and advised me to file a civil suit in the lower court for cancelling the registration. It is a pity to note that the Honourable High Court without going through the gravity of the petition and detailed probe, asked me to file a separate suit in the lower court which is not only a financial burden to me but also a time consuming one and it increases the burden of the lower court also.
In the meanwhile the sub-registrar who registered the sale deed was dismissed from the service. Surprised by the dismissal of the sub-registrar, I raised a query to the Inspector General of Registration asking him the cause of dismissal of the Sub-Registrar under the Right To Information Act. I was intimated that the sub-registrar was dismissed from service for acquiring property without intimating the Head of the Department. I do not accept it as a valid reason since a major penalty cannot be imposed for merely possessing immovable property without prior permission. My acceptance is not a matter of concern but I want to know that whether such a major punishment can be awarded instead of initiating disciplinary action so that I can put forth the fact to the court and seek justice. I expect your valuable points in this regard.
