when the personal loan introduced in the firm, how the rate of interest is calculated? taking the denometer as the 12 months or 365 days? How the rate of interest is calculated? suppose follwing is the situation---- date mentioned on cheque/;--18-sept 2012 date submitted to borrower ---21 sept 2012 cheque is deposited in bank--23 sept 2012 cheque is cleared in bank 25 sept 2012 on which date interest to be required to cal ? what is the correct way to calculate the int rate working from the legal point?

Dear Sirs,
If the company by mistake invested the share premium amount in the purchase of equity share capital of the other company, how it may rectify the said mistake since Section 78 does not permit utilisation of the share premium amount for the said purpose.

I have following Query Related to Co-operative Society. My humble request to you is to enlighten me.
Is it possible to convert an Engineering Co-operative Society Ltd (registered under West Bengal co-operative society act 1983) to a privet Limited Company?
Or whether it will be a promoter/ director/ share holder of any privet Limited Company? Or can it work jointly with any privet Limited Company?
What will be the right procedure to do that?

Is there any provision to reacticate/ reissue the same company name which is strike off. Actually we have a client who has formed a company is 1996 and which name is strike off in 2001 due to not filing of any return from its registration and also not file form 32. now they want to reissue that company name. Is there any possibility?
(ii) If we file a suit in high court for reactivate the company, then what will be the total appox. cost for reactivation.
(iii) Is there any other way to reissue that name as client wants to form another company but with the same name.
(iv) Can we avail the immunity scheme under company law settlement scheme 2011

Dear Sir/Ma'am,
We were earlier a small scale industry and had a dispute with company "A" circa 1995.
Since that time, we grew into a medium sector company.
To recover our dues from company "A", we approached the MSME Facilitation Council for arbitration.
We got an award in our favor.
In this connection, I am looking for any previous Supreme Court/High Courts' verdicts on the validity of an award(under MSME Development Act, 2006/Interest on Delayed Payments to Small Scale and Ancillary Industrial Undertakings Act, 1993) awarded to a medium sector unit on a dispute which occurred when that unit was small scale.
Any help for citations would be greatly appreciated.
