About h form

Party(A)from Gujarat & Party(B) from Mumbai Party(C)agent from Gujarat, Party(A) sold goods to (B) via Agent (C) again ``H`` form and (A)received full payment and also received Account statement from (B)for payment is completed. Party (B) is good company and he export said goods and also he file his VAT return in Mumbai and Mumbai VAT department issue him ``H``.but now (B)&(C) have sum dispute about sum claim ,and (B) hold all company`s ``H`` form who sale via agent(C) to him and (A) also sale his goods via Agent (C).When (A) demand to (B) for his pending ``H`` form then (B) says that if Agent(C) give his claim then & then I give your ``H`` form.
Now (A) received Notice from Gujarat-VAT dept for submit `H` form and (B) can`t give to him, So any legal procedure to received his `H` form from (B.
or when any buyers demand `H` form from VAT dept at that time he bound for give `H` form to buyer ?
or in any CST rules if anybody demand `H` form and when he recived `H` form from appropriate authorities and then he `must` give to seller ?
Now what can I do to received my `H` form ?

Service tax

A Banking Company has sanctioned working capital limit against book debts to its customer "Company A" which is engaged in the business of erection of Hoardings, a serice taxable for service Tax. The said working capital loan is sanctioned against the book debts of Company A. The bank has allowed fiancé on book debt and a charge on book debts duly registered with the ROC.

Now, the bank has come to know that the Company A has defaulted in payment of service tax and hence as per the provisions of Section 87 of Finance Act, the Service Superintendent Service Tax has sent notices to a "Company B" who is the Debtor of "Company A" (the Bank's customer).

Now, the Taxation Department is seeking to recover the unpaid service tax of Company A by instructing Company B that owes money to Company A to deposit its dues to Company A to the Service Tax Department.

However, since the Bank had sanctioned loans against book debts of Company A, the bank claims that it has the first right to recover the dues from Comopany B.

Kindly enlighten if bank can enforce its first right to recover as against the Service Tax authorities. If not then how doees the bank protect its rights??

Sale against e1

my firm is registered in haryana. I want to sell goods in haryana which I purchased from outside haryana. I will purchase on CST. I won't take deliver.delivery would be by trucks. I will send the product directly to my customer.
my question are:
1) whether I have to pay VAT in haryana?
2) How can I trade this as E1 sale or sale in transit under section 6(2)(b) of CST act?
3) would it require E1 form to be issued by my purchase point.

Can we use two pan cards or how we can surrender ?

Hye sir , i want to take advive regarding one of my known , he have two pan cards mistakebly , what trully is .. he has made the 1st card in wrong date of birth , not intentionally , but due to didn,t knowing the importance of pan card and the results of doing such practice , and he have to join some company in which he has to show his date of birth , more than actual .

At the time he made the first wrong pan card , he was 19 years old and did the same in absence of knowledge and had no idea about the importance of pan card . He didn't know at that time what will be the results in future ?

he knows the truth and applied for 2nd card with genuine documents and now he has got it , and he don,t want to use anyone at ay manner. but now he don,t want to use the first one that was with false date of birth documents ,

So he want to surrender the first one , and proceed with second car . But what the problem is he has lot of fear that if he surrender than he come in to some problem of police or courts for any strong punishments( he have to go to custody ) . His intentions are trully genuine all that have been done due to absence of knowledge and inmportance of pan card.

What are your best advises he have to do in this case? and how ? how he have to procced for surrender of card and where he have to contact ? where he have to contact and how ? If there is need to pay any fine , he is ready to pay the same .

Please put light of your value able knowledge so that he can take the right step.

Capital gain tax for educational institution

sir, registered educational trust sold long term property for clearing term loan (debt) of the college to avoid npa status, trust has got 12 a exemption since its creation, through sale of property trust has gained, the entire gain has been remitted to the term loan of the college, in this context whether the capital gain attracts capital gain or income tax, please suggest. if so what is the process has to proceed with the income tax authorities, please suggest

Issue of c form

Mr a have registered business premises in mumbai. He sells goods to mr b(proprietorship business) of mumbai registered under maharashtra vat act . But as goods are manufactured in his gujrat factory so goods will be delivered from his factory to mr b directly. My question mr a will charge vat in his bill or require c form

Income tax on minors family pension

I am 33 yrs old. My wife expired and she was working in postal department. We had a son (5 yrs old now) and I am receiving a family pension for him as guardian. Also I am remarried and working in IT.

1. Do I need to file income tax along with my son's pension income? Is pension income exemptible from my tax calculation?
2. If I invest this pension income in my son's name in RD, FD etc., should the interest gained be clubbed with my income while filing tax? or it can be treated individually?

1.Please advise options for a retiring employee to invest his retirement proceeds of around rupees 35 lakh in such a way that he is required to pay minimum income tax.
