All India Bar Examination

As Iam a student of law i am having a question that recently,BCI(Bar council of India)is going to conducting AIBE(All India Bar Exam)for those who completing the law degree from 2009-2010 onwards which is violating the Sec 24,25,29,30 of Advocates Act,1961 and Art.14,Art19(1)(g) of the Indian constitution.Is it true?If it is true then y bci is conducting such exam to burden the upcoming advocates.But BCI is very adamant to conduct the exam and also says the exam is mandatory.There are more than 10 petitions were filed against BCI throughout India and they were to be heard by SC on Oct20.Before that is there any chance to get stay for this exam.If any chance is there kindly let me know.

there is enough of litigation pending in this regard.

so far there is no stay and the exam is as per schedule.

for the time being keep preparing for the exam, it will be more like revisional exercise for you. Good Luck.

This an honest query... I have also passed B.A.LL.B this year from Calcutta University.

I heard from one the seniors that we practice under CPC and not under Advocate's Act, as it has not been yet implemneted..

IS IT TRUE???

Dear Mr. Aniket,
The bar exam is being introduced precisely for this reason.
That both your senior and you believe that Advocates Act, 1961 is not in force (according to you not yet been implemented).
Both of you also believe you are practicing under CPC - God knows what that means.
If the lawyer is practicing under CPC, then what about criminal procedure code etc.?
If you say that you are a 5 year BA, LLB passed graduate from Calcuta University, should it not occur to you to do research yourself and find out the true fact before posing such a question before this forum? In any case, a mere look at the bare act - Advocates Act, 1961 - would have revealed to you whether it is in force or not.
You may be honest in making a query, that would not in the least absolve you of your minimum responsibility of knowing basics being a law graduate.
