Action against bank

Bank made a clerical mistake while collecting income tax through challan, the assessee has no a/c in that particular nationalised bank. what proper action shoud be taken against that bank and how?

the assessee made the tax payment for the A.Y.08-09 in ten installments (as per direction of income tax officer) through a particular nationalised bank. the bank made the mistakes while putting the A.Y.10-11 inspite of A.Y.08-09. it was happened with seven installments out of ten, rest three was perfect.now online statement of tax payment (Form 26 AS) shows the mistakes.

the mistakes cannt be rectified by bank.

If excess amount is collected by the bank, the assessee can file a complaint before the branch manager and recover the excess amount.

It was also the duty of the depositor to see whether he has an account with the particular bank or not.

Anyway, if banker has erroneously deducted any payment in the name of TDS etc. then it is liable to issue form 16A and if the payment was not deposited with the IT department by banker then it can be got refunded with up to date interest.

ask bank to correct it mistake, they will do the same.
