Cctv in colleges violates students right to privacy?

(Querist) 06 October 2011 This query is : Resolved
this is my moot court problem. in this case a college installed cctv in order to achieve academic excellence and student discipline and also they connected cctv to internet.there was a girl in the clg who was chatting with a boy and her parents saw her chatting through cctv and when girl returned home, she was taken to task by her parents.likes of that girl who were getting monitored by their parents formed a association called students' privacy council and filed a writ petition in the high court, inter alia, seeking a writ of mandamus commanding the college to remove cctv. now i am from behalf of the plaintiff...i.e i have to support that girl...NOTE- there was no security reason to install cctv.

Dear Bajrang,

Question of privacy or right to privacy does not arise in a public place like a college. A college does not provide personal or private accommodation to students. Maintenance of discipline and curbing of illegal activities on the part of the students is the sole responsibility of the college. Moreover, to curb illegal ragging is also the sole responsibility of colleges, for which CCTV cameras are quite necessary to keep watch over the activities of students. So, there is nothing wrong, if CCTV cameras have been installed by the college in its premises.

The question arises, whether the girl student goes to college for education or to waste her time in chatting with boy friends over internet by misusing the facilities provided by the college.

Sorry to say, your case is quite weak. Even the question of security reason has no importance to help the student in her cause. Do you think when security of students is actually breached or assets of the college are targeted or some extremist conspiracy is actually causes any damage to the country only then the college should awake to take security measures? It seems you have forgotten the very recent extremist attack within the premises of the High Court of Delhi.

Sorry to say, I can't wish you success in this particular case even for formality sake, as even if you per chance win the case, it can prove to be a cause of encouragement of more indiscipline and concealment of ragging instances in colleges.
