Pvt company release letter

I have worked for a company and left that organization without serving the notice period. Now the company is not ready to provide the release letter. Am I eligible for it? I am ready to give my months salary for it.

What exactly is this said release letter; Relieving Letter, acceptance of resignation?

What is the reason for declinature?

Is this declinature in writing?

While posting such queries employee should post basic information!

What is this establishment; Govt, private, Commercial, Industrial?

What is its nature of business say; IT, ITeS?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state? Since how many months you are working? Are you under probation period or your service is confirmed in writing?

 

Do standing orders (model/certified) apply to establishment and your designation?

What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Was ever any stinker, memo, show cause notice on any misconduct issued to you?

Does the establishment have its appraisal system? Do you have copy of signed appraisal forms, matrix, KRA’s, performance date? How was your performance?

Are you a member of employee’s/trade unions?

Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card, correct FnF statement, Form 16 as per correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?

Ans. No, one.

Ans. No

Since how many months you are working?

Ans. 10 months

Are you under probation period or your service is confirmed in writing?  

Ans. No

What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Ans. It means I have to inform to the company in writing before 2 months before leaving.

Why do you need the relieving letter?

In general, other prospective employers do not ask for relieving letters for short period jobs. One reason , they may ask is to do a background check whether you are honest or not. It is always better to comply with whatever has been reasonably agreed with the company. Most likely you have abandoned the company without  serving the notice period and the company can withhold the relieving letter for that reason. If they are willing to proivde the relieving letter on the payment of the notice period pay by you, please communicate with the company in writing since they may not issue the letter later. Written communication would help you to make the payment and receive the relieving letter.
