Regarding nfa petition filed by opponent - civil case india

We are defendents in ongoing civil case which was in Issue of Service Stage and suddenly last hearing it went to Amendment stage and my lawyer said NFA petition has been filed by opponent. Out Lawyer has not yet filed my valakath yet and she says it is due to System not showing summons served and now she tell my brother that we need to file written statement in next hearing, is this ok to file written statement even though my vakalath is not yet filed and case is still in initial stages?

Written Statement is to be submitted within 30 days of service of summons / notice to you.

Amendment of plaint has no bearing on filing of written statement after receipt of notice / summons till the amendment sought by plaintiff has not been allowed by adjudicating Court.

The written statement can be filed only after entering appearance in the case and not before that.

The vakalat is the licence to enter inside the case, hence you first ask your lawyer to file vakalatnama and then file the written statement immediately

Let your counsel file her vakalatnama and contest the suit as per law of the land, which she can better analyse the facts and circumstances after going through the plaint / suit filed by plaintiff.
