i want to know two real brother Ramesh Jain and Mukesh jain registred a partnership firm in 1965.the firm is registered in register of company(ROC) and started trading company and build various asset in name of jain trading company. they bought a piece of land near thane in the name of elder brother Ramesh jain and started a construction of a residential building in 1970 and after completion gave other flat to tenant as pagdi system . .Building structure and every municipal assement utara 46 ,43 and municipal property tax name is in name of partnership firm jain trading company .even in jain trading company balance sheet under asset they have declared the building as asset ,and both brother have equal share in this property .
now comes both real brother(Ramesh & MUkesh) have been expired due to there old ages addition and substraction of member in patership firm has been done after there death, partnership business is been continues by there both legal heirs now.
dispute started between both current patner and they have to advise to solve the problem by artittrators as mentioned in pathership deed.
it was been a old residential building build in 1970 and lack of maintance and repair work the structure audit of building fail ,and it was declared a C1 category and it was vacant by municipal copration and tender was float for demolition .
now they building has been demolished by municipal cooperation and the building tenant and owner house area survery was done by municipal and given area certificate was given to all.
my question
building structure is name of Trading company both Ramesh and Mukesh jain are partner.
building plot is name of elder brother Ramesh jain.(now his legal heirs),
Now building is been demolished sohow can Mukesh jain(legal heirs ) can claim his share aftr building is demolished and now plot is name of elder rameshbrother(leagl heirs) no deemed conyance was done.????
how can Mukesh claim is 50% share ,if the new building redevlopemnt is done ??? now problem is that Ramesh legal heirs denies Mukesh share in plot coz no deemed conaynace was there .
what should be done if this is problem ? can you guide me legally
