I I shall be thankful for your advice on the below matter.
A B and C are 3 brothers and directors in their firm x y z private Limited. Their father is the nominated chairman and all three directors have given him power of attorney.
in 1994 there was a dispute. A B on one side along with their father and C on the otherside.
C was removed from his post of MD by A and B. A was appointed as the new MD. The chairman and A transferred immovable assets of XYZ Pvt. Ltd to director B via transfer of shares. No consent was taken from C on the same.
Due to numerous other cases, Mutation of land has not yet happened in favour of B.
Can C challenge this in court and have this registry nullified and cancelled as he is still a member of the was board and his consent was not taken.
