salaries & wages of officers

Querist : Anonymous (Querist) 27 September 2010 This query is : Resolved
Dear Sir,

Please explain the provisions of law where in the management of an organisation is empowered to avoid the payment of arrear money, of revised salary for services rendered in past, to its employees (both workmen & officers).

If this is not possible as per law kindly enlighten us as how to get back the money?
Parthasarathi Loganathan (Expert) 27 September 2010
Every aspect of these issues are solely dependent on the provisions of Bi Partite Settlement between the Management and the Recognised Unions.
Kirti Kar Tripathi (Expert) 27 September 2010
This issue depends on contract of service or settlement under which the arrears are due. So far as remedy available for recovery of the arrear of the workmen are concerned they can seek protection of Industrial Disputes Act by filing the claim under Section 33-C(2) of the act. As regard to officers are concerned they have a remedy in Civil Court by filing a Civil Suit for recovery of the amount....
