RENT AGREEMENT

This agreement is made and executed on of NOVEMBER ,2007, by and between…………. ,S/o Sh ………………. R/o …………. , hereinafter called the Owner (First Party)

AND

Shri………….., S/o…………., R/O……………… hereinafter called the Tenant (Second party)

The expression First and Second Party wherever occur in this agreement, unless repugnant to the contrary, shall mean and include the parties themselves, their heirs and successors.

WHEREAS, the First Party is lawful owner and in possession of the ……………………….on ……………………………………..( Hereinafter called the said Flat) and Second party approached the first party for letting out the said Flat and the First Party has agreed to let out the same to the Second Party on the following terms and conditions:-

NOW THIS AGREEMENT WITNESSETH AS UNDER

1. That the First Party has let out the said Flat to the Second Party.
2. That the tenancy is for a period of eleven months on a monthly rent of Rs. ____/-(Rs.______) w.e.f. ______2008.

3. That the First Party (Owner) has handed over physical possession of the said property to the Second Party on ______.

4. That the Second Party (Tenants) will not sublet, assign or otherwise part with the possession of the said property given on rent by these presents to anyone without written consent of the first party (owner).

5. That the Second Party (Tenants) will not make any addition or alteration in the said property nor will cause damage to the said property.

6. That the Second Party (Tenants) will pay the monthly rent hereby reserved regularly in the first week of each calendar month in advance.

7. That the Second Party will use the said property for residential purpose for themselves and their family members.

8. That the Second Party (Tenants) at the time of vacating the said property will hand over its vacant and peaceful possession only to the first party (owner) in the same position as the first party (owner) has given at the time of tenancy.

9. That the First Party (Owner) and /or his authorized representatives shall be entitled to enter and visit the said premises for inspection and the second party will not raise any objection.

10. That the Second Party has deposited a sum of Rs. ____(Rupees______) with the First Party by way of interest free security which will be refunded by the First Party at the expiry of tenancy period or its earlier termination, as the case may me.

11. That, the First Party hereby assures and promises the Second Party that the Second party abide by the terms and regulations of the Society as per amended time to time. In case there is a Society Complaint against the Second Party, he will be given 15 days time to cure that defect, but in case the Secand Party fails to eradicate that defect in the said time , The first Party can terminate this Agreement by giving a written notice to the other Party.

12. That, the Second Party hereby assures the first party that he shall not create inconveniance to his neighbour (s) and other persons in the Society while he is in tenacy of the said Flat otherwise it will be ground for terminating this Agreement by the first Party.

13. That the Second Party (Tenants) will abide by all the rules and regulations of the Municipal Corporation of Ghaziabad.

14. That during the tenancy the Second party (Tenants) will keep the tenanted property in good conditions.

15. The either party can terminate this Agreement by giving one-month written notice to the other party.

16. That the tenancy can be renewed after every eleven months if both the first and second party mutually agreed on minimum increase of 10% monthly rent.

17. That the electricity and water charges shall be paid by the second party.

LEASE DEED
An agreement made the _________________ day of ___________years between
Sri./Smt._____________etc., (herein after called “the Lessor”) of the one part and
Sri./Smt.____________ etc. (hereinafter called “the Lessee”) of the other part.
Whereby it is agreed as follows:
1. The Lessor hereby demises to the Lessee all that dwelling house with the land
fully described in the schedule hereto together with all out -houses, pucca well,
motor garage, kitchen, pathways, passage, garden and other appurtenances
thereof, situated at _____________ to hold the same to the Lessee from
___________ day of _______ for the term of ______ years (or, year to year)
paying therefor during the said term the monthly rent of Rs._________
(Rupees _____________ only) payable on the first day of the month
succeeding that for which the rent is due;
2. The Lessee hereby agrees that he will during the said term (tenancy) pay all
rates; taxes and other charges excluding the house tax which now are or may
hereafter becomes payable in respect of the demised property;
3. The Lessor hereby agrees as follows:-
(i) That the Lessor shall keep the premises in good and substantial repairs
during the said term and shall annually white-wash and do all necessary
repairs to the out-houses and demised premises and on the Lessee giving
the Lessor notice in writing of any special decays, defects and want of
separation the Lessor will within one calendar month from the receipt of
such notice repair and amend the same;
(ii) That the Lessor shall repair when necessary, the well, the passages,
pathways and the road connecting the provincial road with the
bungalow hereby demised and shall get the well cleaned at least once a
year.
4. Provided always and it is hereby agreed as follows:
(i) That whenever any part of the rent hereby reserved shall be in arrears
for_____ months after due date or there shall be a breach of any of the
covenants by the Lessee herein contain the Lessor may re-enter on the
demised premises and determine this lease.
(ii) The tenancy hereby created shall be determinable at the option of the
Lessor/Lessee (or either party) by giving to Lessee/Lessor (or, the other
party) ______________ calendar month’s notice in writing.
5. It is hereby agreed between the parties that in respect of the demised premises
the parties hereto shall respectively have all the rights and be subject to all the
liabilities of a lessor and of a lessee as set forth in Section 108 of the Transfer
of Property Act, 1882, except Clause (m) thereof which is hereby excluded.
6. It is hereby agreed between the parties as follows:
(i) That any demand for payment or notice requiring to be made upon or
given to the Lessee shall be sufficiently made or given if sent by the
Lessor or his agent through the post by registered letter addressed to the
Lessee at the demised premises (or, at_______), and that notice
requiring to be given to the Lessor shall be sufficiently given if sent by
the Lessee through the post by registered letter addressed to the Lessor
at his usual or last known place of residence or business (or; at_______)
and that any demand or notice sent by post in either case shall be
assumed to have been delivered in the usual course of pose.
(ii) That wherever such in interpretation would be necessary in order to give
the fullest scope and effect legally possible to any covenant or contract
herein contained the expression “the Lessor” herein before used shall
include the owner for the time being of the Lessor’s interest in the
demised premises and the expression “the Lessee” herein before used
shall include his heirs, executors, administrators and permitted assigns.
