Petitioner and respondent of a divorce case are out of India. The divorce petition is filed in India but during the time the case proceeds, both parties arrive at a mutual agreement in the Court of the country where they reside. The said agreement seeks to settle the issues of alimoney and the child custody + support . It also mentions that both the parties waive each other's presence in the Court in India . The agreement is signed and a video deposition is done by both the parties and their attorneys (hired in that country for the purpose) before the Court of the State they reside. Can the petition be converted into joint consent term petition based on the above agreement and dvd of the video deposition? And if both or any one of the parties can not make it to travel down to India, can the Divorce Decree be granted in their absence? Of course their advocates and the power of attorney holders of both parties are available in the court.

i live in bangalore. i brought a flat and it is ready to move in. but my builder is not registering it in my name. every time i go he postpones the date of registration. this is happenning since last 4 months.

My mother expired in the year 2005 and was working in Punjab Govt. Department since 1982.The time she expired a vigilance case was pending against her for which once the judgement came against her in the year 2000, against which the case was filed/appealed at higher court. In the whole tenure since her joining to the Dept. she was not suspended for even a single day and was serving to Punjab Govt. the day she expired. but the Gratuity/PF/Pension and other payouts which are normally given the legal hire of the deceased are still not paid. Kindly suggest whether the department at their own discrition can hold the same or is there any law pertaining to this to hold all the payouts of deceased if any such case/judgement of court is pending the time of demise of an employee. Kindly suggest.. how i can file a case from our side to get all the dues..????
