my mother willed to me the fullyunconstructed second floor of house in gk ii, the constructed first floor to younger brother. I AM THE EXECUTOR OF THE WILL AND HOLDER OF RIGHTS TO SECOND FLOOR OF THE HOUSE. DELHI HIGH COURT GRANTED A PROBATE IN 1995. THE SECOND FLOOR REMAINED UNCONSTRUCTED TILL MARCH 1999. IN MID 1999 MY YOUNGER BROTHER WITHOUT PERMISSION AND WITHOUT ANY MCD APPROVAL CONSTRUCTED A ROOM . THIS LED TO DISPUTE AND HOT WORDS. ON WRITING TO MCD TO REMOVE THE UNAUTHORISED CONSTRUCTION THEY DID NOT ACT BUT SLAPPED ON TAX FOR THIS ROOM FROM APRIL 1,1999. THIS MEANS MCD WAS UNAWARE OF THE UNAUTHORISED ENCROACHMENT BUT DID NOT ACT. A CASE WAS LAUNCED WITH THE PGC FOR INSTRUCTING TO MCD TO REMOVE CONSTRUCTION BUT FOR TEN YEARS NO ACTION. NOW THE FLOOR HAS ROUR ROOMS AND YOUNGER BROTHER IS RUNNING A GUEST HOUSE WITH WEBSITE. THROUGH RTI I HAVE NOW PROOF THAT THERE IS A GUEST HOUSE AT THE HOUSE BUT IN CONNIVANCE WITH HIM THE LUXURY TAX DEPT HAS INFORMED OF THE GUEST HOUSE BUT NOT ON WHAT FLOOR IT IS. WE WERE NOT GRANTED INTERIM INJUNCTION BECAUSE THE JUDGE RELIED ON THE AFIDAVIT OF YOUNGER BROTHER THAT HE IS USING SECOND FLOOR FOR RESIDENTAIL PURPOSES. AT THAT TIME WE DID NOT HAVE STRONG EVIDENCES TO NAIL THAT A GJUEST HOUSE IS RUNNING. WE HAVE WEBSITE PHOTOS AND LUXURY TAX DEPT CERT NOW. WE PLAN TO APPLY FOR INTERIM INJUNCCTION AGAIN. MY BROTHER HAS TAKEN A FALSE, COMPLETLEY FALSE PLEA IN COURT THAT THE SECOND FLOOR WAS GIVEN TO HIM BY ME IN EXCHANGE FOR RELINQUISHING HIS RIGHT TO LUCKNOW PROPERTY. THE FACT IS THAT THE WILL CLAERLY STATES THAT THE TENANCY RIGHTS OF LUCKNOW PROPERTY ARE BEING PASSED TO ME SOLELY. THE LUCKNOW PROPERTY WAS NOT OWNED BY MOTHER BUT GIVEN ON RENT TO MOTHER BY THE LUCKNOW DEVELOPMENT AUTHORITY. I HAVE ALSO FILED A CRIMINAL COMPLAINT UNDER SEC 156(3) AT PATIALA HOUSE. HEARING IS ON MAY 24. I AM INFORMED BY A SPREME COURT LAWYER THAT I SHOULD BOMBARD WITH CRIMINAL CASE. ALSO SUGGESTED THAT I SEEK REMEDY AT LUCKNOW HIGH COURT, UNDER THE LAWS OF THE LAND. I LIVE IN LUCKNOW AND MOTHER LIVED WITH ME AT LUCKNOW. THE GK iI HOUSE WHERE THE GUEST HOUSE IS RUNNING IS IN S BLOCK, WITH A ROAD NOT MORE THAN 15-18 METRES FACING IT. SIR, MY QUERIES ARE :- 1. WHAT PROVISIONS OF MCD ARE BEING VIOLATED? I AM INFORMED ABOUT SOME CASE OF MC MEHTA 4377/1985 DEALS WITH IT BUT COULD NOT LAY HAND. AM ALSO INFORMED THAT SEC 15.7.2 OF DELHI MASTER PLAN 2021 DEALS WITH IT. 2. IS THERE ANY REMEDY FOR YOUNGER BROTHER SWEARING A WRONG AFFIDAVIT IN COURT THAT HE IS NOT RUNNING A GUEST HOUSE AND USING IT FOR RESIDENTAIL PURPOSE AND THE JUDGE RELYING ON THIS INCORRECT AFFIDAVIT. THROUGH RTI I HAVE THE LUXURY TAX DEPT REPLY THAT A GUEST HOUSE IS RUNNING. I HAVE ALSO WEBSITE CONTENT SHOWING PHOTOS OF ROOMS AND INFORMATION THAT YOUNGER BROTHER IS RUNNING GUEST HOUSE WITH HIS E MAIL ETC 3. A CIVIL CASE WAS FILED IN JULY 2007 AT TIS HAZARI UNDER ORDER 39 RULE 1 AND 2 READ WITH SEC 151. CODE OF CIVIL PROCEDURE AND A SUIT FOR DECLARATION THAT I, NOT THE YOUNGER BROTHER IS OWNER OF RIGHTS TO SECOND FLOOR AND PERPETUAL INJUNCTION AGAINST YOUNGER BROTHER RESTRANING HIM FR OM OBSTRUCCTIONG MY RIGHTS OF PEACIFUFL ENJOYMENT OF INHERITED RIGHTS OF THE SECOND FLOOR. sir plz help me out to file a case against a girl who make my life worst in all sense of life. she always use to say to marry me but after in touh for years than she refuse to marry. and she also meet to my family and assure all that i ll marry him in any how. i m in big tension and my faamily too. sir i m not able to think about any more. why she done that sir.. if i done with a girl than her family will definetly file case against me.. but as i m boy i want to do this against them to prove that boys also have emotional attachemnt n feelings from heat. please sir help me out.

Dear Sir I was born a Buddhist but converted to Christianity when I was 7 years old. When I adopted Christianity I got my baptism name. So basically I have two names; one I was born with and the other when I got baptized. I have used my baptism name in all my school documents such as exam certificates and school leaving certificates. My passport, pan card, birth certificate all carry the name I was born with. I will be leaving for Hong Kong next year for further studies; I may face problems as my name in the documents is inconsistent. I have my baptism certificate which was issued by the parish but I don’t think that certificate is legally valid in India. Please advice.Thanks

Dear raj sir Arbirtration proceeding regarding service tax is pending in my company .The arbitrator asked us to file original contract agreement on record as per c.p.c 1)whether is it proper to file original on record , 2) if arbitrator refuse to give original after arbitration award what Action to be taken 3)if arbitration award passed against us ,we definately challange in Hon'ble high court , can high court call the record of arbitration procceding from arbitrator Thanks in Advance for immidiateb reply
