    My client’s mother had got notice from one nationalized bank that My client’s mother was given guarantee to Mrs X’s term loan and after getting such notice my client and his family shocked and found that the original land document ( Sale Deed) was not in home, his younger brother confess that he has given the said document to Mrs X husband just for study the deed but Mr X & Mrs X without my client’s brtother’s consent given the said document to Bank as mortgage, after filling the RTI against Bank, the bank has send photocopy of one affidavit and Mortgage documents, as my client’s mother is illiterate so she just can put thumb impression and from the photo copy its not clear that photo attach with the affidavit and the thumb impression too. My client is sure that his mother neither had given any thumb impression nor given any photo to the bank as she is suffering from illness and always kept lying on bed since 10-15 years. Now my clients wants to get back there Land document to their own custody and he also want that his brother also become safe. I need the suggestion what steps should I take on behalf of my client so that I can help them to get justice. Regards S Paul M- 09435393500

    An Oral partition of ancestral property was made between two brothers about 50-60 years back and they were having the benefit of the respective shares allotted to them till recently. One of the brothers died about 40 years back. The surviving brother and the sons of the diseased brother entered into a partition list in 1990 citing the oral partition made and the properties allotted were listed in the partition list drafted by a senior advocate. The partition list is unregistered. About few years back the grandsons of the diseased brother have filed a suit against all other family members claiming their shares. My Queries 1) Wanted to Know if Oral Partition done long back is valid, and in case Yes what are the points that needs to be highlighted to court. 2) I would like to know the reference Case numbers for which the Courts has passed the judgments for Oral partition Cases. Kindly let me know for reference. 3) What are the disadvantages of not having the partition list unregistered? Kindly address my queries which will be of great help to me at this point of time.

    Respected Sir This is Venu from Andhra Pradesh and intending to know a little bit of information from you. I am explaining below my problem. My grand father purchased some land during 1940s from jamindars and applied for grant of patta to survey settlement and land records during 1960s. He had two sons. After the demise of my grand father, the proceedings for patta moved by my fathers brother. The survey settlement and land records granted patta in favour of my fathers brother though the patta applied by my grand father in the name of XYZ & Sons. Later the local MRO filed a petition in court and high court also gave judgement favouring us recently. But registration formalities and issuing of pattadar pass books not yet done and recently only, the local MRO conducted survey again basing on the high courts judgement. Now the problem is my fathers brother not writing the papers for our share. Actually, we have an oral agreement and as per the agreement, we are entitled for 75% of share. In this context, I would like to know the rights available to me. Is it possible to grant the patta in favour of my fathers brother directly even though my father not given any approval? Please let me know the rights available to me and how to handle the case to get our 75% share property. If any evidence require for our oral agreement, somany persons can attend.
