    Hi, my wife is working with a coopreative bank in Mumbai. At the time of joining, she signed a indemnity bond of three year which asks for 75000 if she leave the bank before 3 years. However, the working conditions in the Bank are not good and she wants to resign. Also after almost 2 years she is not confirmed, whereas the probation period was 1 year. What options do we have. If she resigns, can we have to pay 75000 as we have signed the deed or we have a case as she is not confirmed even after 2 years and work conditions are bad.

    Hi Raj I used to have a credit/card and used a little bit of it and remember repaying what i used and dont even remember what happened to the card after that. Now recently some recovery agents came calling that i had maxed out on that card 6 years ago by withdrawing cash and they said they have the statement etc. The point is, what were they doing for 6 years ? i dont remember anything abt that debt at all. i've had many credit cards and availed several loans for the last 10 yrs and availed a car loan as recent as last year and nothing ever showed up on my credit report or else i wouldnt have got the loan sanctioned. now the recovery agents are saying that the card was used to the tune of 50,000 and with interest now it's over 4 lacs. i never received any kind of communication with them in all these years, either telephonic or email. I want to know what my rights are in this case and if there is debt is time barred for recovery.. please help

    Sir, I have heard that there is an SC ruling which holds salary as a matter of right. That is nobody can withhold any government servant's salary if the employee has not been punished with 'dies non'. One of the experts has suggested that no ruling is required since this should be read with the contracts act and minimum wages act. But I could not find any specific reference to this effect in both the acts. Unless there is a SC or HC judgment interpreting it in such manner, it is difficult to prove a link. Could you please quote some HC or SC ruling which prove that salary can not be withheld and it is a matter of right except in cases of dies non?

    CASE STUDY Dear sir, I have an important case to present in front of you.. That a person burrowed a sum of some amount as, Loan no -1, ( House building loan)from a bank,.by mortgaging his house registered in his nameThis loan was subsequently paid by the co borrower, - his wife and the account was kept standard after the death of the burrower. Now the deceased man’s had 2 sons and his wife as legal hire. The man then had made a will where he had wished his wife as the sole beneficiary of all the land and house and his assets. The youngest son had taken loan from the same bank without any co lateral or mortgage while his father was alive. The father or mother did not stand as a guarantor or burrower to this loan. The loan was taken to start a small scale industry which was covered under an insured coverage of cental govt ( C.T.G.S.M.E) where one time & the annual insurance fees was regularly paid. Subsequently the second loan taken by the younger son went bad and was sent to the DRTA .Now the second son kept no contact with the family since last three years before the death of his father. The Bank was quiet these years and never wrote to the father , mother or any one about the son’s loan from the date of its sanction or its failure. Now after 3 years after coming to know that suddenly the father has died they are assuming. to take the mortgaged property for loan no -1 keeping into view that the younger son is the legal hire to his father’s property though for this loan the father never had mortgaged the house nor an extension of mortgage was done or the father stood as a guarantor for the loan no -2 during his life time.
