  • posham venkatesham says : land
Sir, I bought a open plot in Hyderabad. Person A had given 12 guntas of land as GPA with possession deed to person B. But, person B aligned plot in adjacent land (person C brother of person A)& sold to person D. By knowing , successors of person C agreed & get GPA on that plot to one of successor with same measurements. Successors of person C made their own layout & sold plot to me. But, in first link document, land owner name(A),pass book no, patta no, measurement of plot, borders defers from my document. My document writer mentioned old link documents also in my new sale deed. All 5 successors of person D made sale deed to me with their own pass book no, patta no. Earlier, Successors of person C applied for layout regulation for old measurements. Please advice what to do to get layout regulation for new measurements. Sir, please advice whether I go for rectification of 2 link documents & supplementary for my new deed. For this who have to present. Namasthe, sir, P.V.

  • Hari Prasad says : Hindu succession act 2005 amendment
I would appreciate reply/clarifications from advocates on daughter’s claiming on properties sold long time ago by their family members.. Becausse of Hindu succession act 2005 amendment was done retrospectively, lot of cases are cropping up all over due to high valuations of lands in recent times. A Lady named Papamma had a self acquired property purchased from others in the year 1952-53. In the year 1989-90, Upon death of the Mother, 4 sons of Papamma acquired the title through succession and got the Pani n revenue records transferred the property in their names. They have also obtained a family tree and Inheritance certificate (IHC) from local Tahasildar’s office showing that they are the only 4 children having an absolute ownership of this property. Based on this, after due verification of all docs, I have purchased this property in 1995 in Bangalore under a registered sale deed and got all revenue records (Pani n Mutation registers etc.,) transferred in my name and have been paying taxes regularly to the revenue dept since then. Before I purchased this property, it was a baron/dry land. After I bought it, I had installed bore well in 1996 itself and made a compound wall/fencing all around and have developed the property in to fertile cultivable land with a Mango/Teak/Banana trees and have been growing other vegetable by myself and am in peaceful possession of the said property till date. I have received a court notice recently from One Lady called Venkateshamma (claiming herself to be a daughter of Papamma by producing a new family tree which is different from the one produced by her brothers at the time of sale of the property to me) claiming that Papamma had 7 children (4 male of which one died as bachelor.. and 3 female children totalling 6). Claiming that she was not party to the sale deeds executed by her brothers in 1995 and under Hindu succession act,2005 she is entitled to 1/6 share of the said property. I purchased it in 1995 and am in possession of the same till date and cultivating it by myself. Upon checking, we came to know that the Papamma Family member are still holding few more other lands in the Joint family name. Apparently now they have concocted with this lady with a malafide intention to file a suit on to my property sold by them long time ago to make some wrongful gains now. since from the date of death of Smt. Papamma i.e., 25 years back, and the present suit filed after long lapse of almost more than 25 years, will it be barred by limitation? Is there any merits in the case since the family members of Smt. Papamma had alienated the properties very long back for their legal necessities and utilized the sale consideration amount for their family needs which could have also been taken by daughters also and Do the daughters still have any right to question the alienation after the long lapse of more than 16 years with false and frivolous grounds? Could you pl enlighten me on how to go about this case and if at all Venkateshamma (claiming to be the Daughter) has any legal grounds to fight n win the case and on what ground I can get the case dismissed? If there are any judgements to this effect, Pl give me references of the same. Thank you. Hari prasad. meva@live.in 10/2/11

  • Ashish Kumar says : hi
Sir, Please let me know whether my registered marriage be annulled on the ground that while registration was going on I was under influence of alcohol and was not in a position to think what was right and wrong? I m a central govt. servant in PSU of 33 years and did registered marriage 4 months ago. But we havent started living together. I m in a great trouble now as the girl repeatedly harassing me to live together and my professional life has become a hell in answering her questions. I just cannot live together with her as I found there exists a vast dissimilarity of thinkings and habits between us. I requested her to get divorce from me, but she refused. Please help me sir. What should I do? If forcefully I have to live with her, my life will become a hell. So, I m asking you whether this registration be annulled on my above said ground? Because all other grounds may not be applicable for annulment. What proof will have to be produced to show that at the time of marriage, i was completely under influence of drugs or alcohol and not in a position to think what i was going to do? Please help me.... it was a registered marriage which was done under maharashtra regulation of marriage bureaus and registration of marriages act 1998, volume six. the registration was done for visa purpose but now i dont want to live with her. she would only ruin my life. pls help... I got the registration out of some emotion for which I m now lamenting. i flew out of india just after the registered marriage and so i was not able to decide in a hurry. Since we have not lived together, can this marriage be annulled. The girl actually dont want to get this marriage annulled. The marriage certificate is with her and she will never hand over it to me. Without the certificate, is it possible to get annulment? Can a marriage annulment application be produced at court from only my side without her consent? Help me sir, I m in a great trouble. I just cannot start living with her. I m a govt servant and this case has taken away my peace of mind. The registration was actually done in a hurry and I was not in a position to think and decide rightly at that time. This also was done against my parents knowledge. Now the girl is forcing me to start living together. But I can never consummate with that girl due to complete dissimilarity between thinking and habits of us.Please help me and guide me to get this marriage annuled one sidedly. I got engaged 4 to 5 months back and I registered my marriage after engagement to start visa processing. Actual marriage was to happen later(which never happened).I flew out of India immediately after marriage registration. After marriage registration girl true colours came out and we decided to cancel the marriage. Now girls side started blackmailing us of different laws like 498 (didnt even know there was such thing till that point) and said they are willing to cancel the certificate legally if we pay them a huge amount which came down finally to 8 lakhs(We didnt take any dowry at all). Now they say that they dont want to come to court yet as after 1 year they can file divorce and proceed to get more amount(by demanding property share). What options do I have now: 1)Can I file for marriage annulment or my only option is divorce because its just been 4 to 5 months 2)If I have to wait for divorce I am afraid they will just prolong it to get more money. 3)Do they really get rights to share the property even without a single day of marriage life?? I dont have any property really. I bought a house for my parents which is under my name as I pay my EMI. 4)Can I start criminal proceeding against them for blackmailing us for filing wrong cases on us and for demanding money?? they just have the engagement photographs not the cd, can they prove on this basis that the marriage happened between us? sir, i am a reputed enggineer in PSU and i have never seen any court procedings in my whole family life, but i just want to get rid of this girl anyhow shortly and easily if possible.. if u guys can help me out to provide some relevant proceedings and cases against them .. please help.
