Case short details : • Going to start the South Indian Restaurant at commercial property called “Gulab Avenue”, franchisee with Sankalp Recreation Pvt. Ltd. (Ahmedabad) (Chain of Sankalp Restaurant) • Building called “Gulab Avanue” is a Residential cum commercial building, Ground Floor is Commercial, and above 1st to 5th Floor are Residential Flats total 18 Flats. • We are Restaurant owner have purchased full Ground Floor premises (total 5 Shop) namely S.B. Enterprise (All partner are Ladies member) premises given on rent to M/s. Super Foods, (All partner are husband of S.B. Enterprise’ partner). • Super Foods, having Shop Act License, Food License and also Sub Divisional Magistrate’s Registration of Eating House. Also Jamnagar Area Development having the Zone table which shows that Restaurant activity is permissible to this premises and area. • All Flat owner and Association of flat owner called Gulab Avenue Condominium are creating hurdles and restricting to us for not starting the Restaurant. • Lower court Jamnagar Principal Civil Judge –declare that “stay” not to start Restaurant • So we have made Civil Misc. Appeal to Court of the Principal District Judge, Jamnagar – they have rejected the appeal and status co is continued. • Enclosed documents : Lower court Jamnagar Principal Civil Judge –copy of judgement Civil Misc. Appeal to Court of the Principal District Judge – copy of judgement Copy of Shop act License, Food License, SDM registration of eating house. Copy of Jamnagar area Development Corp. Zone table shows restaurant is permissible. We have filled another suit against flat owner regarding their illegal construction, so corporation has submit the inspection report and also final report to the Honourable High Court, but Commissioner of corporation not interested to take action against Flat owner even though Honourable high court oral order to take appropriate action as per law. So we have filled another petition to the honourable high court against Commissioner of Corporation to take action against illegal construction. Please advise your opinion. Hello sir, My husband purchased a house in mumbai before our marriage and brought his parents and sister to stay with him in that house(my husband is the sole owner of that house)when we got married we shifted to bangalore because of transfer of my husband's job..its 4 years we r staying in bangalore and my inlaws in mumbai in my husband's house...i just wanted to know that since they are staying in that house can in future they ask for their share in my husband's owned property?(my husband pays the EMI n also the maintanance towards the house and all the papers of the house are on his name)

DEAR SIR, CAN A LOKADALAT JUDGE SIGN THE AWARD(2007) IF IT COMES UDER DOUBLE JEOPARDY EVENTHOUGH BOTH COMPLAINANT & ACCUSED SIGNED. IF SIGNED BY THE ACCUSED ALSO KNOWINGLY OR UN-KNOWINGLY ON THE ORDER. COMPLAINANT TAKING UNDUE ADVANTAGE OF THE AWARD. THE SECOND CONDITION OF IMPRISONMENT AFTER COMPLYING THE PAYMENT OF 50 THOUSAND ON THE SPOT IN THE COURT AND ALSO FILIED A PETITION IN THE SAME COURT FOR EXECUTING THE SECOND PART OF THE AWARD. CAN THE COMPLAINANT FILE AGAIN ON THE SAME ORDER EXECUTION ONCE THE AMOUNT IS RECEIVED BY HIM AS PER THE AWARD. EXCEPT IMPRISONMENT IS NOT ALLOWED BY THE JUDGE. CAN THE COMPLAINANT ASK THE SAME JUDGE TO REVIEW HIS OWN ORDER & IMPLEMENT THE SECOND PART OF AWARD IMPLEENTATION. IS THE COMPLAINANT PETITION CAN BE MAINTAINABLE IN THE SAME COURT BEFORE THE SAME JUDGE??? LOKADALAT s ARE CREATED TO SERVE NOT TO PUNISH IF THIS APPLIES THEN WHY THE PUNISHMENT PROVISON COMING IN TO THE PICTURE FOR A FINANCE COMPANY IN THIS CASE. KINDLY GUIDE ME WHAT TO DO & HOW TO AVOID THE SECOND PART BECOZ THE ACCUSED IS A GOVERNMENT SERVANT & THEIR ENTIRE FAMILY COMES ON ROADS IF IMPLEMENTED. IS THIS IS THE MOTTO OF LOKADALAT?? THE COMPLAINANT DEMANDING NOW TO PAY 1 LAC TO WITH DRAW THE CASE ELSE HE SEE THAT THE SECOND PART WILL BE EXECUTED. KINDLY TELL ME THE LEGAL REMEDY PLSSS.
