    1.That I am married to Seema Naz D/o Ab. Subhan Ganaie R/o naik bagh nowgam from last five years and we have a daughter aged 3 ½ years out of this wedlock. 2. That my wife deserted me in the month of April 2011 and joined her parents home and misinformed them and lied to them that I beat her and sent her away. 3. That without any proper mode of inquisition my father in law called me on the same day and verbally abused me and my parents including my brother. 4. That I remained calm and let week pass so that they may be able to mend their behavior and realize their mistake and also the lies and false allegations made by my wife. 5. That a period of two weeks passed and none of her elders made any approach to my family to reconcile or sort out the differences. 6. That after two weeks I personally contacted my wife and tried to reason with her in a calm and decent mode. But she showed quite stubbornness and immature attitude. 7. That finally I approached one of her close family acquaintance, a lady who also happens to be a mediator in solemnizing our marriage. She wished to act as an arbitrator out of goodwill to which both my in-laws and my family showed satisfaction. 8. That on next day I accompanied by my mother and that lady went to their house to clear the misunderstandings and try to reconcile. Everything went fine and at last my mother asked my wife to come home to which my mother in law interrupted that she may stay further for a night. 9. That all this time my daughter was confined and upon seeing me her joy knew no bounds and she jumped into my lap and requested me to take her home. She also requested her mother i-e my wife to join us in the car. As soon as I boarded the car their whole family pounced on me and snatched the child from my arms forcibly not taking into the slightest consideration the effect of this act on the child both mentally and physically. 10. That when my mother tried to intervene my unmarried sister in laws roughened her and pulled her hair and beat her. On hearing wails of my mother few neighbors came out as it was nearly 10 pm and consoled her. On seeing this I couldn’t control my emotions and called back home to tell them what happened. In the meantime no member of my wife’s family tried to rescue us or correct their daughters. Subsequently my brother, my uncle and my aunt arrived at scene and on seeing my mother’s plight and her bruised face an obvious heated scene ensued which lasted nearly 10-15 minutes. 11. That inspite of being at fault and provoking such an incident my in-laws resorted to most uncivilized and immoral response whilst hurling choicest of abuses and dancing to the tunes of them. Further the sister in laws attacked us with poles and iron rods. One of their cousin brothers who happen to be a police officer instead of trying to contain the situation caught hold of me and threatened to shoot me thereby aggravating the scene. 12. That finally on neighbors insisting and assurance to resolve the dispute on next day we left the scene and filed a complaint with police station nowgam at nearly 11 pm of the night. They assured us that they will look into the matter in the early morning and try to sort things out and also take action against the guilty. 13. That on next day we were called in the police station nowgam and to our utter dismay we found that our complaint was sidelined and an FIR registered against us where my in-laws set up us for all the wrong allegations by misuse of their cousin’s official status. The SHO nowgam tried to help settle the dispute but my in-laws won’t budge in framing us and also used foul language inside the police station. To add to it we had to furnish a bail for getting out inspite of being innocent of the crime for which they had given false reporting. 14. We spent the day as shocked as we were and tried to understand what actually transpired in between. On next day as if this was not enough women police accompanied by SHO rambagh came to our house and shocked us further that a case under 498a and 406 stands registered against us and our relatives. I was taken to police station again where SHO assured me that I was not arrested yet and had to wait till all my family do not show up and then we will discuss and sort out the issue mutually including the in-laws. 15. That I suspected foul play and called my parents and they got anticipatory bail for all of us. When they reached the police station with the bail the SHO did not release me, instead they took all of us to office of SP south which lies adjacent. There I tried to tell the truth to SP south who instead of listening to me continuously rebuked me on the pretext of using my English language as a mode of communication. Finally he simply ordered me to be put in lockup and SHO women division cheated on me by showing me arrested earlier while others were released. 16. That how could they arrest me without proper investigation and absence of any incriminating evidence and not adhering to recent modifications about modus operandi laid by Supreme Court and Delhi high court in connection with this domestic POTA. I was mentally shocked at my arrest and subsequent lock up for two nights developed asthma like symptoms for which I am now on medication. 17. After my release I was called up many a times on pretext of settling dispute and harassed mentally despite having an absolute bail. I didn’t quite understand why she was taking so much personal interest and pressuring me to give in writing that I won’t repeat what I haven’t done and what they had alleged, to which I straightly refused. 18. That during this time I came to know the ulterior motives of my wife behind all this and also that she was being provoked to do the same. For that is another long tale and needs thorough and detailed briefing. That only dispute between me and my wife is the frequent visits to her parent’s home whilst overlooking the marital duties and obligations and their interference with my business and relations. My wife has resorted to sudden bad behavior with my parents and further my in-laws instead of correcting their daughters aggravated the conditions. 19. That during all this ordeal of trauma they haven’t even spared our minor daughter by confining her, not even allowing me to occasionally take her home for a day. I somehow managed to meet her twice during these two months and found that they are alienating and poisoning the child by telling her that her father is evil person and that he quarrels with her mother. Our daughter herself told me the same not once but twice that one of my sister in law and her grandmother says the same. When I enquired from my wife she put it aside by saying that she comes to say all of this by herself. And when our daughter wanted me to take her back home my wife gave her a quiver look and refrained from accepting her innocent wishes as the child is better attached to me. 20. That even though my wife and my in-laws didn’t leave a tiny space for reconciliation nor approached my parents for reconciliation neither succeeded in appointing a wise and learned arbitrator to settle the dispute amicably, I still approached my wife personally and tried to make her realize the implications of separation and its subsequent effect on the development of our child. But her mind seems to flicker and I could judge that she couldn’t think independently. 21. That after exhausting all the means both to convince my wife about regaining marital status on principles and for betterment of I failed miserably and now that she is using my daughter as a tool to frustrate me and give in writing that I won’t restrict her and our daughters visits to her parents home no matter how frequent they may be to which I have serious objections. 22. That the cousin brother of my wife is misusing his official position by covertly influencing the investigations and framing me in this case which seems clear as SHO women police station instead of investigating impartially is favoring my in-laws which I came to know while having a conversations with my wife while trying to make her come to an understanding. She has also told me that it was on directions of SHO women wing that she is not allowing me to take my daughter home or to meet her at my freewill.

    Dear Mr. Makkad, I would please like to have some legal advice regarding my marriage with an non indian citizen wife (she is not from Pakistan or any neighbouring). I found out that India provides PIO to my wife, but real query is my wife's passport has to be renewed every five years, so if my wife wont be able to renew her passport what can happen? I know you must be thinking that I should tell my wife to renew her passport but thers is a bit complication in that. My wife is an muslim country citizen and her country will take legal action on her if she enters that country to renew her passport (as marrying Hindu person is illegal as per to her country's law). For renewing her passport she personally have to enter the country as we found out that her embassy dont do it for some legal reasons. In this sitution when she can't renew her passport her PIO will get cancelled automatically if I am not wrong? so if her PIO gets cancel is she going to be an illegal person/ migrant in India?? As being me an Indian citizen how I can keep my wife in India without breaching any Indian law. Please do reply it would be indeed a great help. Advice will be greatly appreciated as I am tensed with my maritial life. Kind Regards, Rahul

    My Father purchased a Plot of 120 Sq.Yard in Jeevan Park, Libaspur Delhi in the year 1974 registered in the name of my father and younger uncle. Now, The patwari of Alipur area said us that this land has been merged in gramsabha and aquired by Govt. He said that we can't claim for alternate plot or compensation. But in actual this area is not aquired. There is a developed residential Colony and some industries and godown are also there. please advice me how we can take the possension of our land or compensation & alternate plot against them.
