  • Prashant says : Index II query in case of correction deed
We have purchased a flat in Navi Mumbai of which area are as follows: Carpet Area of flat : 349 sq.ft. Attached Terrace Area: 353 sq.ft. But while agreement builder has mentioned 349 sq.ft. carpet area of flat and terrace area as 87.25 sqft which is 25% of 353 sq.ft. My queries: 1) What terrace area should be mentioned in the agreement? 87.25 or 353. 2) We discussed this with builder and he has agreed for correction deed. but he says that in Index II, in area related details, there is will be mention as "as per the agreement" and not the the carpet area and terrace area(whole). Please advise.

Dear sir, thank you for your reply in regards to my query regard can title be disputed (5/7/11)?- i request you to take little pain for me. As your opinion successor have no right to dispute title. Now after 30 years of selling out land with possession, successor of party one in my query, has forcibly & illegal entered in our residential plots & destroyed Khoonts & fencing on boundaries of each subplots 10 months back & 2 month back from now, they entered & created encroachment in corner of one subplot. They are demanding money & threatening us not to come on our land. According to police, mastermind in our case, is also involved in other 10 to 12 such illegal encroachment & demanding ransom money to avoid harassment. we have filed complaint before police, but police refuse to take any criminal action(police took only bond to maintain public peace). We met superintendent of police & collector, but we don't feel, they are eager to do something. Now, the party 1, who sold his land 30 years back, has died 8 years back. he hasn't approached any civil court in his life to dispute his sell way back in 1981. So according to you title cannot be disputed by his successors. Now its purely a matter of illegal encroachment, possession, demanding ransom money by taking our residential plots in ban & threatening. (we have all government agencies's evidences to say plots are in our possession & wasn't in possession of successors of party 1 till they enter forcefully & illegally.) We have filed application before exe. Magistrate under crpc 145 within 25 days of their entry. How far this will help us to remove these people from our land? This act of these elements is purely criminal act, how criminal proceeding helps us? Or is civil suit only remedy to acquire peaceful possession from elements who have entered illegally & forcefully even though title is indisputable or they are not in position to dispute title? Is there any other remedy?
