  • Vishal Khorasia says : Flat vendor does not cooperate in transfer of flat
I have purchased the flat in co-op. HSG in Kandivali (W) with total amount of Rs. 61.5 Lakhs fully paid on 24th Jan'2012. The agreement states that Vendor is supposed to get NOC for transfer of flat share certificate and vendor will pay maintenance until purchaser becomes the member of society. Since Society is asking for Rs. 30,000 (against the max. limit of Rs. 25,000) as a result Vendor is not even applying for transfer of share certificate. As per sale agreement vendor and purchaser will have to pay transfer premium equally that come out to Rs. 15000. Vendor has not given posession letter in writing though I have already took the flat posession. Vendor have original share certificate. But Vendor is harassing me with uneven reason that they do not have time to courier the posession letter and I require to collect same from there house along with original share certificate. They are not even willing to come to society for application of transfer of flat and they have decided to pay only share of Rs. 12500 only. Though I have already got mentally harasessed while purchasing the flat and due to late payment by 20 days I had to pay extra money of Rs. 32000 on and above money mentioned in sale agreement. I see the non-cooperaton by vendor as per agreement can be breach in agreement and is criminical act. I have attached the copy of 4 pages of agreement for your reference. Request your advice on what to do for transfer of share certificate. Is this criminal case and Can I register FIR against Vendor in Kandivali (W)? Thanks.
