  • srikanth says : advice
    • My father in law left behind 2 property one in chinmayya nager and other in saligraham both in chennai . My father in law died in 1995 leaving behind legal heir a son and daughter. • There is an indication of a existence of ‘ will’ which is in possession of daughter but so far not probated. A have letter with me signed by sister-in law husband stating that he is the executer of the will. • Son (legal heir) passed away in 1997. • I was in possession of the property in chinmayyanager after the expiry of my ex-husband. The property is situated in prime location. All papers transferred in my name, except sale deed • When i left for abroad, the daughter in law entered into sale agreement with prospective buyer claiming 100% share of the property in chinmayya nager. The sale never took place. • After i returned i was advised by my counsel to enter into sale agreement. So based on this wrong advise i entered into sale agreement with Mr. X, who has no source of income but was known to us. No money was transacted, but agreement was registered. • I went to Delhi , putting some tenant in my house in chennai. • During my absence in Chennai my sister-in law colluded with the prospective real estate agent , Mr. Thangaraj and contacted Mr. Kesav bribed him and sold 50% of the property by executing sale deed.Mr. X gave power to Y to execute the sale. • The counsel for Y created documents and sent letters including summons to chennai address where i never lived. So i was kept ignorant of whole case until i received notice from court about specific performance suit against me to sell the property to the purchaser. • • My question is how can a power be given by x without becoming a owner of the property to thangaraj, can a criminal suit filed gainst him. • Can this be fought as land grabbing and case be filed in police about illegal grabbing . • The whole issue is murky taken advantage of my absence • I have hired 10 lawyers paying them dearly, but none of them helped me because i was out of station. Some of them never attended when case was on and this has paved way for ex-party judgement in form of injunction restricting me to put tenent • The said broker , Mr. Y has erected outhouse etc and put a watchman Pl advise me and help.
