Sir, my client had purchased a land, there were tenants in the property, the plot of land was purchased in the year 1974, somehow the deal could not be completed, however the original vendors expired, their legal heirs executed a declaration in favour of my client and an irrevocable general power of attorney for consideration in the year 1992, my client told them to enter in to conveyance deed in order to complete the transaction, the legal heirs did not came forward, consideration was also paid to the legal heirs, my clinet thereafter filed a suit under the instructions of a lawyer in 2001 and obtained decree without service of summons on the legal heirs, on the basis of the Irrevocable power of attorney the husband executed consent terms in favour of the wife, accordingly orders were passed in view of consent terms, thereafter one of the tenant challenged the decree, on the grounds of fraudulent act of the parties, the legal heirs wer also the parties to the proceedings the tenant had served the writ of summmons to the legal heirs of the vendor but they failed to raise objections and hence the court found that as the legal heirs have not raised any objections the decree obtained is no fraud, now the legal heirs have entered into deed of conveyance with the developer and registered their agreement, my client has not yet registered the decree as the tenant has filed appeal before the high court, i have filed a suit to restain the developer from creating third part rights, i was successful but now how do i deal with the unregistered document, please guide me Regards Adv. Ajay Talreja Bombay, High Court

  • saurabh sharma says :
I have bought a car. while going on to batala, i met with an accident. the car was driven by my brother-in-law. After the accident we both got injured and refer to the hospital. Meanwhile FIR been lodged and insurance company has been informed for the said accident. we have a total loss of 6lacs rupees. But the insurance surveyer has prepared a report for only 3lacs rupees. i filed a complaint in consumer forum. They took the plea that at the time of isuing the license by the appropriate authority my brother in law has not completed the age of 18 years, so they repudiated my claimon this ground. but before this they have already paid two claims to my brother in law and now they demanded the same to be refunded. But i have a document from the motor vehicle authority which proves that i have a genuine license. 1. how did i prove my case. 2. Is there any SC or National Commision judgement on this issue.
