Sir, my name is Pramod Mishra and before 10 days my younger sister's father-in-law expired on duty.His 2 sons, first son's presently status is Uneducated and mentalist disturbed,and previous one year do not know any body where is he.Second son low educated and unmarried.my sister elder son's wife. and her mother-in-law uneducated and 55 years old. Sir I have a blank cheques given to me by a partnership firm. Since they owe me some money which I had given to him .I do not have anything else. I came to know They are closed that bank account and company 3 years back.Can I deposit the cheques now and legally raise a claim on them and how?

The matter is in Mumbai High court placed in front of the Court Commissioner for trial The petitioner is throwing his weight around for eg he summons our witness he puts the matter on the high court board etc His lawyer has no control over his wrong doings I am the defendant my lawyer says that since its not a criminal offence the court will not take any action against him as it is a testamentary suit We are in the process of proving the last will made by my parents The petitioner has already acted on this last will which was made in Goa However he insists on the court granting him probate to the will made previous to the last will to enable him to be the sole owner to a 245 sq feet Mahda flat in Byculla Myself and three other sister are also the legal heirs to the same property To claim his title then petitioner wants to settle us according a govt approved valuer for which we are all against We want the said property to come on all 5 names Please advice thank you
