    HELLO SIR'''I M LLB 3rd sem student..i have to prepare for my first moot court presentation..so i need ur help..The problem is as follows On 2nd January,2005,the SKIMS Hospital Srinagar declared Abdul Ahad as brought dead.On that morning the village committee(name of village SAGARAMA0 had started raiding the houses in order to capture the heating appliances which caused overloading & hence disruption of light in the whole village. During the raid the village committee mostly collected the heaters used for cooking purposes. On reaching house of Jamal ud Din, the accused Kabir Khan intervened & told the village committee that Jamal ud Din being a poor man, he should be allowed to use heaters for cooking purposes on humanitarian grounds. On this, the deceased namely,abdul Ahad who was also the president of village committee replied that the decision of village committee applies on all & none shall be allowed to use such heating appliance. The accused & deceased exchanged words which escaped in hot talk. The deceased blamed the accused that you are covering the Jamal ud Din as you have intention to grasp his two marlas of land adjacent to your house. The accused suddenly caught the neck of deceased & hit his head thrice with an earthen pot ( called KANGRI) . the Accused ran away & deceased chased him. the accused soon realized that he can't escape ,he stopped after running away 200 meters. The deceased on reaching caught hold of his neck but before he could have done anything, he felt down on ground. Immediately he was referred to Hospital where he was declared bought dead. The accused was later arrested by Police 7 presented before trail court. the trail court framed the following Issues: a) Whether (person) accused has commited the offence of murder? b) Whether the accused was provoked by the words of deceased? c) Whether the accused had committed the grievous hurt which culminated in the death of deceased. I M from the Prosecution Side,,,So i Need help..Please Oblige..Thank You

    sir, I want to know about declaration of adoption. my client who is 59 years old has no issue. so he and his wife had adopted a child in 1988 from his real younger brother. At the time of adoption child was 14 years old. Till then adopted child is living with adoptive father and mother. Adopted son got married before 8 years and he has one kid also. natural father of adopted fellow died recently. there is no dispute about adoption between all of them. But problem is that there is no single documentory proof of adoption. There is no any subordinate documentory evidence also. In all official records natural father’s name is shown behind adopted fellow. Now my client wants to give effect of adoption in all official records by substitute his name as a father. he wants to insert name of his adopted son in revenue record of rights of his agreecultural land but revenue authority refused for the same. he says that there is no valid adoption. what should i do? whether I have to file a suit for the declaration for the status of adoptive father or adopted son has to file a suit for the status of adopted son? who may be the parties to the suit and which releif may be asked? please guide me. jitendra- junagadh

    Dear Sir, Its Azeem Afrasiyab Adv from Punjab Pakistan. I defaulted in bank loan and case for recovery was filed against me which was subsequently decreed and execution was started, i filed an application under Order XXI Rule 66 of CPC which has also been decided. now at present stage what should i do in trail court to delay the matter as i am not in position to pay the decreetal amount and also want to save my property mortgaged with the bank as the court may be order for auction of subject matter property may be on next date of hearing i.e., 14-05-2012. please reply soon as i have very short time to file any petition or application under the purview of Order XXI of CPC may be

    Dear Sir, I have defaulted a loan with IDBI bank in the year 2006 now 7 years later they issued a arrest warrant towards me and asking me to pay the arrears. I have agreed to pay them the arrears but my problem is the Manager says i have to bee in the court for 5 or 10 minutes before the judge to call of this case. My question is can i appoint someone on my behalf to do so because he says that even if you pay the money its upto the judge to agree for my presence..Please help as i am not able to make it to mumbai because of my job..
