Dear Sir, MRO(Thahasildar) and complainant filed a tresspassing case against us in 2007 and case is proved false now. Also Tahasildar and complainant together demolished my small house in 2007 in the same survey no of tress passing case. I want to file a defamation case against Tahasildar and Complaiant for false tress-passing case and criminal case for wrong demolishing of my small house in 2007. Since case is proved false (favour to me) shall I file a defamation case for 5 year struggle and for creating lots of damage for my livelihood? Your response is invaluable to me to proceed further. "Z" has got some properties in 1953 by the death of his father. and he has a second wife (married her after the death of first wife), a daughter born prior to 1956 from the first wife , a son and three daughters from the second wife. in 1998 he made an unregistered partition between only with him and his wife and son, stating that he is suffering from his old age so he cannot maintain the whole property so he is dividing the property with them. after that unregistered partition in records of the said properties the name of the son is entered as owner of the property in 1998. later in 1999 "Z" was died. now in 2012 the daughter born to first wife of "Z" has filed a suit for partition against her brother stating that the unregistered partition was made without her consent and it is not binding on her. now her brother the son of "Z" taken the defense that "Z" has got property as a single heir to his father by the death of his father prior to the commencement of HSAct 1956 so "Z" was the absolute owner of the said property and the unregistered partition between "Z" and him has to be considered as the testamentary disposition of the property to him by his father "Z". my question is, whether the unregistered partition can be considered as testamentary disposition of the said property? whether the daughter is eligible to claim any share from the property of her brother which has given to him by his father? if she is eligible to get share, what is the ratio of her share?

I purchased a resale flat in kolkata for 27 lacs which is under construction.The same flat was purchased by the seller for 18 lacs 2.5 yrs back. wht will be stamp duty valuation will it be 27 lacs or on circle rate.

Aseason says : Challenging the Will
The father has left a will stating the daughter will get the inheritance to the property only if she marries to the guy the father has named in the will. This guys has misbehaved with this girl multiple times, insisting that she marry him and she is not willing to marry this guy. Just before the father died, this guy had attempted to commit suicide and then filed a FALSE case against the girl stating she was responsible for driving him to commit suicide. Can the girl refuse to marry this guy and still get inherit the property ? Please advise.

Sir, i have a query related to my mothers property if you can give your advise i will be thankfull yo you sir. in year 1985 johnpaul mabe a GPA agreement with Laxmikanth For a land and in year 1990 john paul sold that land to my mother through all legal formalities but again in 2003 laxnikanth sold that land to naresh. sir my query is: 1. who is the rightfull owner of this land whether my mother or naresh? 2. can a gpa holder sell without owners concent? 3. if my mother want this land to get despute free what are the legal formalities she need to perform?
