Police Hera Pheri ????

Guest (Querist) 12 September 2010 This query is : Resolved
My mom,65 + yrs., applied for her registration under senior citizen cell of Delhi Police,as she lives alone in a separate property and fighting a case of eviction from her tenant.

I,her single child, a son, live separately with my family, just in front of her house.

Two head constables of Delhi Police visited my mom 's residence and as she is illiterate ,she brought them to my house, here they got me filled up a senior citizen cell registration form (though it had been already dispatched online and offline in both ways to Delhi Police),One of those constables wrote a letter on my behalf declaring that I live just in front of my mom's house and I take care of my mother and got me signed this letter, diverting my attention by telling a story of some heinious crime committed in the neieghbourhood.

After 10 days, when we inquired about my mother's registration,to our surprise it was declined because I was taking care of my mother and my mom's age was 55 as per a photo copy of her voter card of 1998(which was never given by us to them).Though our tenant had this copy and had furnished in the court.Obviously this copy was given by the tenant to these policemen along with a bribery.

I have written a complaint against these policemen raising following points----

It was a verification of my mother, not of mine, then under what law, these two constables took a letter from my side ?Is it necessary for this registrtion to take a declaration from the children of the senior citizens that whether they take care of their parents or not? If the children of the people, who have been registered under this cell, would be asked that whether they take care of their parents or not, almost none would declare that he/she does not care of their parents. Then what was the need of that particular letter which was dominantly taken from me by these two head constables. And how could the registration of my mother be accepted or rejected on the basis of that letter taken from me ?

The fact is, I and my mother live in separate premises,we do whatsoever we can do for her, which is always felt insufficeint to her,she feels insecure all the times, because she is figting a court case to get eviction from her teanat, who lives in the first floor of the premises in which she resides, many a times she could not sleep just because of fear of being alone in that particular premises. So please get her registered under this program.

The facts are my mother's voter card has never been updated in record of voter card's office,it has also been declared non functional years ago by the same office. My father's name in English is written as "Chand" and in Hindi it is written as "Singh".The voter cards of those times are full of mistakes. They have declared a male as a female ,what to say of ages shown in these cards.Hence I want to assert that the age shown in this card is invalid, actually this whole card is invalid and not in force at all.So I request hereby that the copy of this card, which was never furnished by my mother, never self attested by her, and also the letter written by your head constable, signed by me under his pressure be considered null and void .

Should I file this complaint letter ,may not I or my mom come under some danger due to hostility of these police people,or is not there any chance of arousal of some legal problem for me or my mother ?

Is there some other wayout ????

your mother is entitled to be registered as senior citizen irrespective of whether you reside with her or not. It depends merely on the proof of age and nothing else. Now that your mother resides alone she can inform the police about this and seek fresh registration again. If it is refused she can approach the court directly with the age proof herself. She need not be worried about her security and all since it is a very formal affair.
