ENEFITS ON RESIGNATION AFTER RENDERING 9 YEARS AND 7 MONTHS

I have resigned from central govt group A gazetted services after obtaining permission.I have served 9 years 7 months.prior to that I worked 16 years in indian air force and drawing pension.I have applied for counting my past military service with present service before resignation whereas that was turned down as not agreed as per pension rules.By that timeI have received permission to resign.since there was no time to putup application for reconsideration.I was releived fromthe service in the month of dec 2010.Presently I yet to receive any money from my dept.Now they are telling no benefits other than my PF on resignation. I was thinking I may get Gratuty after rendering 5 years of serving.
Kindly advice on the following
1. What are rhe benefits from central government services on resignation after obtaining permission to resign?
2. whether I am elegible to get gratuty or not?
3.What is the difference between Resignation and allowed to resign?
which category I come under?
4. Is it possible to take up my past military service counting for the purpose of pensionon my last sevice? if yes kindly advice the procedure

Hi,
Had you consulted some expert before submitting tour resignation you would definitely have been advised not to submit your resignation to lose precious and pensionable service of 9 years & 7 months.

Anyway, reply to your queries is as follows:

1) Since resignation entails forfeiture of past service, as per provisions of the CCS (Pension) Rules, no benefit is allowed for any service rendered. Since PF is your own money, you can withdraw that inclusive of interest. BUT mind it, interest is also stopped on deposits if kept beyond 6 months after quitting service.

2) No gratuity is allowed, as past service is treated as forfeited.

3) "Resignation" is on your part, whereas the term "allowed to resign" is on the part of the competent authority. So, no difference between "resignation" and "allowed to resign". These terms are symbolic denoting the nature of action on the part of the employee and the administration.

4) You were late to take up the case for counting of past service along with the present service for pension purposes. You could well have taken up the case for allowing the pat service to count towards pension in the present post immediately after joining the present service. Had you been able to get your past service allowed, you could well have got all the benefit of pension & gratuity based on the presently increased emoluments with total pensionable service of about 30 years, [(16+9.5 years) + 5 years more added to your more than 25 years of service] after applying for voluntary retirement.

However, HOPE SUSTAINS LIFE. If you still can get approval of your past service to be counted towards pensionable service and also simultaneously get approval to withdraw your resignation with condonation of the break between the effective dates of your resignation and rejoining and thereafter apply for voluntary retirement after some gap of time, you can get all the due pensionary benefits.
